These Terms and Conditions are a legal agreement between you (the adult parent or legal guardian creating and managing an account) and WonderWell Learning, LLC. By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

These Terms apply to parents and legal guardians only. Children do not enter into this agreement.

1. Who We Are

WonderWell Learning, LLC (“WonderWell Learning,” “we,” “us,” or “our”) is an online educational platform providing live classes, curriculum resources, and learning tools for homeschooling families.

2. Who These Terms Apply To

These Terms apply to you as an adult parent or legal guardian who creates, maintains, and is responsible for a WonderWell Learning family account. To use our Service, you must:

Children registered under a family account are not parties to these Terms and Conditions. Children do not agree to or accept these Terms. The parent or legal guardian who creates the account accepts these Terms on behalf of the family and is solely responsible for all account activity, all purchases, and all participation in promotions, sweepstakes, or other programs offered through the Service.

3. Your Account

When you create an account with us, you agree to:

You may not use a username that infringes another person’s rights, is offensive or obscene, or impersonates another person or entity.

You may not create more than one account per household. Multiple accounts created to gain additional entries in sweepstakes or promotions are prohibited and may result in disqualification and account termination.

4. Parental Consent and COPPA Compliance

WonderWell Learning is committed to complying with the Children’s Online Privacy Protection Act (COPPA), 15 U.S.C. § 6501 et seq. By creating a family account and registering a child under that account, you, as the parent or legal guardian, represent and warrant that:

We collect only the minimum information necessary about children. We do not collect a child’s last name, date of birth, email address, phone number, gender, or grade level. If you believe we have collected information about a child beyond what is described here, please contact us immediately at contact@wonderwelllearning.com.

You may withdraw your consent and request deletion of your child’s information at any time. See our Privacy Policy for instructions.

5. Purchases and Payments

All purchases on the WonderWell Learning platform (including live class registrations) are made by you, the adult account holder. By placing an order, you represent that you are legally authorized to enter into a purchase contract.

When you make a purchase, you will be asked to provide payment information. You represent and warrant that:

Payment is processed by Stripe. WonderWell Learning does not store your credit card number. See Stripe’s Privacy Policy at stripe.com/us/privacy.

5b. Pricing

We reserve the right to change our prices at any time. Price changes will not affect orders that have already been confirmed, except in extraordinary circumstances (such as a pricing error or government-imposed change). If a price change affects your confirmed order, we will notify you and you will have the right to cancel.

5c. Order Cancellation and Refunds

We reserve the right to cancel or refuse any order if we detect fraud, unauthorized transactions, pricing errors, or if the service is unavailable. Our refund policy is described separately in our Returns Policy, which is incorporated into these Terms by reference. Please review our Returns Policy before making a purchase.

6. Live Classes and Educational Content

WonderWell Learning offers live online classes conducted by teachers on our platform. By registering your child for a class:

6a. Recording of Classes

WonderWell Learning records every live class session. Recordings serve two purposes: (1) allowing enrolled families who missed a class to watch the session at a later time, and (2) maintaining a record of class content for dispute resolution purposes. By accepting these Terms and registering your child for any live class, you acknowledge and consent to this recording practice. The following rules govern all recordings:

7. Promotions and Sweepstakes

From time to time, WonderWell Learning may offer sweepstakes, contests, and other promotional programs through the Service. All promotions are subject to their own Official Rules, which govern in the event of any conflict with these Terms. Please review the Official Rules for any promotion before participating.

The WonderWell Learning Service and all of its original content — including class materials, curriculum, graphics, text, software, and trademarks — are and remain the exclusive property of WonderWell Learning, LLC and its licensors. Our content is protected by U.S. copyright and trademark law.

You may not use our trademarks or trade dress without our prior written permission. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written consent.

9. Your Feedback to Us

If you submit feedback, ideas, or suggestions about our Service, you assign all rights in that feedback to WonderWell Learning. We may use your feedback for any purpose without compensation to you. If for any reason that assignment is not effective, you grant us a permanent, worldwide, royalty-free license to use your feedback without restriction.

Our Service may contain links to third-party websites we do not operate or control. We are not responsible for the content, privacy practices, or terms of any third-party website. We encourage you to review the terms and privacy policies of any third-party site you visit.

11. Account Termination

We may terminate or suspend your account at any time, without prior notice, if you violate these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ends immediately.

You may close your account at any time by contacting us at contact@wonderwelllearning.com. Upon closing your account, we will delete your personal information as described in our Privacy Policy, except where we are required by law to retain it.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WONDERWELL LEARNING’S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO WONDERWELL LEARNING IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED DOLLARS ($100.00).

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WONDERWELL LEARNING AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF PRIVACY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages. In those states, our liability is limited to the greatest extent permitted by law.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WONDERWELL LEARNING EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or harmful components. We are not responsible for the accuracy or reliability of any information provided through the Service.

14. Governing Law and Disputes

These Terms are governed by and interpreted under the laws of the State of Arizona, without regard to conflict-of-law principles.

If you have a concern or dispute about the Service, we encourage you to contact us first at contact@wonderwelllearning.com to try to resolve the matter informally. We will make reasonable efforts to respond within 10 business days.

If we cannot resolve a dispute informally, any legal action arising from these Terms or the Service shall be brought exclusively in the state or federal courts located in Navajo County, Arizona. You consent to personal jurisdiction in those courts.

15. United States Legal Compliance

By using the Service, you represent and warrant that you are not located in a country subject to a United States government embargo or designated as a terrorist-supporting country, and that you are not on any United States government list of prohibited or restricted parties.

16. Availability and Errors

We work to keep our Service available and accurate, but we cannot guarantee it will always be so. We reserve the right to correct errors, update pricing, and change or remove content at any time without prior notice. If you discover an error in pricing before completing a purchase, please contact us.

17. Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and all other provisions will remain in full force and effect.

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

18. Changes to These Terms

We reserve the right to update or change these Terms at any time. If we make a material change, we will notify you by email and by posting a prominent notice on our website at least 30 days before the change takes effect.

Your continued use of the Service after the effective date of any revised Terms means you accept the new Terms. If you do not agree to the revised Terms, please stop using the Service and contact us to close your account.
